Recent research has brought to light substantial fragments in Egyptian demotic, Old Coptic and Greek of manuals of divination by means of drawing lots. Typically, the lots carry a number, and each is attributed to a particular deity. This article presents the documentation known today, including some strips of palm leaf which could have served as the actual lots. It also discusses the degree of variation between the different manuscripts, and possible specific links between the gods and the answers to (...) which they are linked. (shrink)

INTRODUCTION The present volume unites contributions by the leading figure of the Vienna Circle and by two of his closest assoCiates, contributions that deal with an area of thought represented, indeed, in this Collection but certainly not the central one in the common picture ofthe Circle's activities. It is no accident that an interest in ethics and the philosophy of action was particularly marked in what Neurath was apt to call the right wing of the Circle. For them, as for (...) Wittgenstein (the respected mentorofSchlickandWaismanninparticular),theadvancetobehoped for in philosophy consisted not solely in freeing natural science from a confused sense of dependence on speculative metaphysics but also in seeingthatotherareasoflanguageandaction hadto bethoughtaboutin theirownterms, whichwereneitherthoseofnaturalsciencenorthoseof philosophy as traditionally conceived. Friedrich Schleiermacher (1768–1834) hat die Ethik als Theorie der Strukturen und Formen der geschichtlichen Welt konzipiert. Seine Entwürfe dieser „Wissenschaft von den Prinzipien der Geschichte“, die im Zusammenhang mit Vorlesungen ausgearbeitet und erst nach seinem Tod veröffentlicht worden sind, haben für seine Philosophie wie für seine Theologie grundlegende Bedeutung.

Friedrich Waismann (1896–1959) was one of the most gifted students and collaborators of Moritz Schlick. Accepted as a discussion partner by Wittgenstein from 1927 on, he functioned as spokesman for the latter’s ideas in the Schlick Circle, until Wittgenstein’s contact with this most faithful interpreter was broken off in 1935 and not renewed when exile took Waismann to Cambridge. Nonetheless, at Oxford, where he went in 1939, and eventually became Reader in Philosophy of Mathematics (changing later to Philosophy of (...) Science), Waismann made important and independent contributions to analytic philosophy and philosophy of science (for example in relation to probability, causality and linguistic analysis). The full extent of these only became evident later when the larger (unpublished) part of his writings could be studied. His first posthumous work The Principles of Linguistic Philosophy (1965, 2nd edn.1997; German 1976) and his earlier Einführung in das mathematische Denken (1936) have recently proved of fresh interest to the scientific community. This late flowering and new understanding of Waismann’s position is connected with the fact that he somewhat unfairly fell under the shadow of Wittgenstein, his mentor and predecessor. Central to this book about a life and work familiar to few is unpublished and unknown works on causality and probability. These are commented on in this volume, which will also include a publication of new or previously scattered material and an overview of Waismann’s life. (shrink)

German literature played an important role in Kierkegaard's reading, and he often relates to German authors in his writings, especially to those of the period between 1770 and 1830. Against the background of German Romanticism, he deals with Romantic irony in the second part of The Concept of Irony. His harsh verdict on famous German writers like Friedrich Schlegel and Ludwig Tieck in his master's thesis is in some cases relativized by a more balanced appreciation in other writings. Some (...) German authors like Georg Christoph Lichtenberg and Jean Paul served as stylistic models, while others like Gotthold Ephraim Lessing offered valuable inspirations for his thinking. One of the most frequently cited poets is Johann Wolfgang von Goethe, who appears in Kierkegaard's writings throughout all his working periods and is dealt with in a very comprehensive manner. Leben Totgesagte langer? Manche sicher, aber immer nur selektiv - Friedrich Carl von Savigny, dieser unser deutscher Starjurist vom Ursprung unserer juristischen Moderne, so global geworden wie kaum ein anderer, war gewiss so ein Fall von immer neuen Selektionen. Nur, so ist die Frage, wie selektiv, wann und wo? In diesem Band wird untersucht, welche seiner Denk-Stucke man verstand und wie oder ob doch gar nicht, in Frankreich, Italien, Spanien, Brasilien, England, U.S.A., Danemark, Schweden, Norwegen, Finnland, Russland, Japan und (...) China. 'Nicht- verstehen' konnte leicht geschehen an so ungleichen Zeiten, Orten, Politiken und Denkkontexten und geschah durchaus. Man kennt bisher nur diese und jene "Einflusse". Nun kommen ganze Denkweisen und Rezeptions-Bilder zur Sprache. Beide Aspekte werden in profunder Quellenbeherrschung erschlossen und analysiert. Und dies geschieht konsequent an bestimmten Schlusseltexten und Savigny-Bildern. So fliessen die Studien einmal nicht auseinander, sondern zeigen zum einen die Denk-Stucke selbst, dann ihre vielfaltigen Verwendungen in anderen Kontexten und schliesslich die Metamorphosen der Savigny-Bilder. Die Differenzierungen losen sich nicht irgendwohin auf, sondern sie werden zu sprechenden Gemeinsamkeiten und Unterschieden, Tendenzen und Strukturen. Eine summierende Schlussbetrachtung und eine erstmals umfassende Bibliographie der Ubersetzungen, systematisch nach Sprachen und chronologisch nach Werken geordnet, schliesst den Band ab. Generationen von Studenten, von Arndts bis Windscheid, sassen in Marburg, Landshut und Berlin zu Fussen Savignys und lauschten in der Vorlesung dessen Worten. Ihr Vermachtnis sind ungewohnlich zahlreiche Vorlesungsnachschriften zu Pandekten, Institutionen, Romischer Rechtsgeschichte, preussischem Allgemeinen Landrecht, Methodologie und weiteren Materien, die Savignys Lehren von den Anfangen als junger Professor bis zum ungekronten Haupt der Rechtswissenschaft widerspiegeln. Da Savigny keine Lehrbucher publizierte und sein grosses Hauptwerk zum Privatrecht erst ab 1840 gedruckt wurde, lasst sich sein Einfluss auf die Rechtswissenschaft seiner (...) Zeit nur mit einem Blick auf die Vorlesungen vollumfanglich verstehen. Eine Reihe von Lehrstoffen ist ebenso nur hier uberliefert wie die Veranderungen im Laufe der Jahre. Die hohe Autoritat von Savignys sog. Kollegheften ist gut bezeugt und schon an der konkurrenzlosen Uberlieferungsdichte ablesbar. Seine zahlreichen Schuler und Horer rezipierten Savignys Lehren in ihren eigenen Vorlesungen und Publikationen und verstarkten damit ganz erheblich seine Wirkung als Lehrer und Forscher. Die Edition dokumentiert nach langjahrigen Recherchen diese enormen Quellen erstmals voll. Auch die Kontexte sind aufbereitet nach Horern, Stundenstatistiken und allen bekannten, weiteren Quellen. Die Edition stellt dazu in Wort und Bild fur den Zeitraum von 1802 bis 1842 die Vorlesungsmanuskripte und rund 140 erhaltene Nachschriften von den USA uber Europa bis nach Japan vor. Endlich kann man also gezielt auf Savignys Lehren zu bestimmten Fragen und aus bestimmten Zeiten zugreifen. (shrink)

Karl Friedrich Christian Krause’s concept of penal law, though little noticed in Germany, can be regarded as almost revolutionary for its time, as it assumes that public law is not only – negatively – intended to delimit and guarantee the citizens’ spheres of freedom. Rather, the law should also promote the welfare of the citizenry. As a result, Krause’s considerations of penal law do not focus on law enforcement alone, but just as much on the resocialization of both the (...) offender and the victim. In contrast to utilitarian positions, the perpetrator must not be instrumentalized for the benefit of society, e. g. for preventative purposes; rather, the offender has a subjective right to be rehabilitated. Correspondingly, the victim has a right to compensation on the part of the state inasmuch as the offender’s means prove insufficient. (shrink)
